In this workmen’s compensation case, employer Robert Hawthorne, Inc.1 appeals the board’s2 affirmance of a referee’s dismissal of its petition to terminate, suspend or modify benefits to claimant Robert 0. Stone.

In September, 1967, the claimant had suffered severe injuries, including a broken neck, when the tractor-trailer, which he wias driving for the employer, overturned. By agreement, the employer has paid the claimant $52.50 a week.

On May 13, 1977, the employer filed the termination petition, alleging that the claimant had recovered from his injuries. At the…
