—In an action, inter alia, to recover damages for breach of contract, the defendant El-Kam Realty Company (a New York Partnership) appeals, as limited by its brief, from so much of an order of the Supreme Court, Westchester County (Nastasi, J.), entered June 4, 2002, as denied its motion for summary judgment dismissing the complaint insofar as asserted against it and on its counterclaims to recover damages for breach of contract.

Ordered that the order is modified, on the law, by (1) deleting the provision thereof denying those branches of the appellant’s motion which were for summary judgment…
