The defendant [Christian Salentine] having been convicted of violation of certain provisions of the internal revenue law, a motion for new trial was made on the ground of misconduct of one of the jurors.

The question bearing upon the right of the defendant to a new. trial arises upon the misconduct of one of the jurors while the trial of the cause was in progress. At the beginning of the trial the jury were cautioned against having any conversation with any person about the case, and against allowing any person to approach them for the purpose of having such conversation, and against permitting any conversation relating to the ease to be had in their presence.
