The plaintiff in error instituted an action against the defendant in error in the district court of Oklahoma county. The defendant demurred to the petition on the ground that it did not state facts sufficient to constitute a cause of action. That demurrer was sustained. The plaintiff refused to plead further, and judgment was rendered in favor of the defendant. The plaintiff appealed to this court.
