Appeal from District Court, Wichita County; P. A. Martin, Judge. B. A. Lester was convicted of following the occupation of selling liquor in local option territory, and he appeals.

The indictment charges that appellant, in justice precinct No. 4, followed the occupation of selling intoxicants while local option was in effect, in this: That on or about the 10th of July, 1912, and anterior to the presentment of the indictment, appellant, in justice precinct No. 4, Wichita county, did then and there engage in and pursue the occupation of selling intoxicating liquors in violation of said law, which law was then and there in full force and effect in said justice precinct No. 4, Wichita county, Tex., and that the said Lester did then and there, on or about the said date, to…
