Plaintiff Michael J. Wheatley appeals from the trial court order dismissing his suit against defendant, the Chicago Transit Authority (CTA), on the basis that plaintiff did not serve the CTA with notice of his injuries within six months from the date of his injury or file suit within one year of the date he received the injuries as required by section 41 of the Metropolitan Transit Authority Act. 70 ILCS 3605/41 (West 1994).
