OPINION

BUSSEY, Presiding Judge.

The appellant, Charles Elsworth Zackery, hereinafter referred to as defendant, was convicted, upon trial by jury, in the District Court, Oklahoma County, Case No. CRF-76-1697, for the offense of Assault and Battery with a Dangerous Weapon, After Former Conviction of a Felony, in violation of 21 O.S.1971, § 645. The jury fixed his punishment at a term of two (2) years in the custody of the Department of Corrections and on October 1, 1976, the defendant was sentenced in accordance with the jury’s verdict.
