While it may well be that the Department of Motor Vehicles (“DMV”) failed to conduct an adequate market survey in accordance with the procedural requirements of the Procurement Practices Reform Act of 2010 (“PPRA”)1 to support the challenged “minimum needs” itemized in its solicitation for new driver’s licenses, thereby warranting a remand, I cannot agree with the majority’s legal analysis and proposed framework for the Contract Appeals Board’s (“Board”) review of agency solicitations going forward.2 The majority’s opinion departs not only from the Council of the District of Columbia’s (“D.C.…
