This suit was instituted by Elsie New in January, 1941. Its object was to obtain a partition of a tract of land of ninety-seven and one-fifth acres, located in Buchanan County, Virginia, and to have .a one-ninth share therein laid off and assigned to the complainant. The one-ninth share in-*629eluded a one-tenth interest of which the complainant’s mother was alleged to have died seized and possessed and one-ninth of a one-tenth interest which the complainant inherited from an uncle.
