OPINION

BLISS, Presiding Judge:

Appellant, William Suggs, Jr., hereinafter referred to as defendant, was charged by information in the District Court of Pottawatomie County, Oklahoma. Defendant was subsequently tried before a jury and convicted for the • lesser included offense of First Degree Manslaughter. His punishment was fixed at four (4) years in the State Penitentiary, and from said judgment and sentence, a timely appeal has been perfected to this Court.

Due to the nature of the propositions of error urged by defendant in his brief, only a concise statement of the facts is presented here.
