Petitioner, Marlon Jermaine Smith, was convicted of armed robbery and use of a deadly weapon during the commission of a violent crime. The trial court imposed a sentence of twenty-two years for armed robbery, and a concurrent five-year sentence for the weapon charge. This court granted certiorari to review petitioner’s belated appeal from the denial of his application for post-conviction relief (PCR).
