In this case three primary coinsurers contest the apportionment of defense costs that were expended on behalf of an insured. In 1983 Cablevision Systems Development Company and affiliated corporations, partnerships, and individuals (“Ca-blevision”) were sued in an action entitled Nishimura v. Dolan, 83 Civ. 0085 (JRB) (E.D.N.Y.) (the “Nishimura action”).
