Youcheng Wu v. Jian Xu

In an action, inter alia, for declaratory relief, nonparty David M. Lira appeals from so much of an order of the Supreme Court, Rockland County (Alfieri, Jr., J.), dated October 9, 2013, as granted that branch of the plaintiff’s motion which was pursuant to 22 NYCRR 130-1.1 for an award of attorneys’ fees and expenses payable by him and, sua sponte, directed him to pay a sanction in the amount of $2,500 to the Lawyers’ Fund for Client Protection, and the defendant separately appeals from the same order.
