OPINION AND ORDER

This matter is before the court on defendant’s motion to dismiss. For the reasons set forth below, the motion is DENIED.
Plaintiff Maree Gallo and M.G., an infant who sues by her mother and next friend, filed suit on September 17, 2003, against the United States under the Federal Tort Claims Act, 28 U.S.C. § 2671, et seq. Neither plaintiff is represented by counsel.
