BEAM, Circuit Judge.
The State of Iowa, through Warden Gris-pus C. Nix, appeals the district court’s grant of a writ of habeas corpus to John L. Hrbek. Hrbek, an inmate at the Iowa State Penitentiary (ISP), alleged in his habeas petition that the ISP disciplinary committee denied him due process when it disciplined him based on only “some evidence” of his guilt. The district court determined that due process requires the committee to apply at least a preponderance of the evidence standard of proof. Accordingly, the district court granted Hrbek’s petition.
