Belair v. MGA Entertainment, Inc.
Court of Appeals for the Second Circuit
1Opinion of the Court
SUMMARY ORDER
Plaintiff Bernard Belair appeals from an award of summary judgment in favor of defendant MGA Entertainment, Inc., on Belair’s claim that MGA’s Bratz dolls, as well as the sculpt, or underlying form on which these dolls are based, infringe his copyright in a photograph featured in an advertisement for Steve Madden shoes (the “Angel/Devil Girls photograph”). We review an award of summary judgment de novo, and we will affirm only if the record, viewed in the light most favorable to the nonmoving party, reveals no genuine issue of material fact.
