The plaintiff, Strobel Steel Construction Company, appellant in this court, brought an action in the Municipal Court of Chicago against the Sanitary District of Chicago, appellee, to recover a balance alleged to be due for the construction of a dam known as the ‘ ‘Emergency Butterfly Dam” located in the drainage canal of the Sanitary District of Chicago.
