SMITH, Chief Justice.

At the July 22, 1944, primary election, F. H. Lee and Gabe Whitehead were rival candidates for the democratic nomination for the office of County Commissioner of Precinct No. 3 in Wilson County. In due course the County Democratic Executive Committee canvassed the returns and certified that Whitehead had received 259 votes at said election as against 257 votes cast for Lee, and was thereupon declared to be the nominee. Lee thereafter, in due course, on August 2, 1944, filed his contest of said election in the District Court of Wilson County, and issue was joined by…
