1. Introduction
This is a civil rights action against the City of Worcester and members of its police department. The plaintiff, Kevin H. Jaroszuk, alleges that members of the City of Worcester police department committed an assault and battery on him and violated his civil rights under federal and state law during the booking process on March 19-20, 1999 by using excessive force against him and by acting with deliberate indifference to his medical needs.
