This was an action of ejectment to recover the possession of four hundred and forty-one acres of land, known as the Ebenezer Bran-ham tract. The plaintiffs showed that the legal title from the Commonwealth was vested in them. The defendant was in possession, and claimed title by virtue of three tax-sales. The only material question in the case is, whether the land was unseated at the time of the tax-sale in 1854. It was sold at that time for the taxes assessed for 1851 and 1852.
