Appeal by defendant from a judgment of the County Court, Westchester County (Nicolai, J.), rendered April 24, 1984, convicting him of burglary in the second degree, and petit larceny, after a nonjury trial, and imposing sentence.

Judgment affirmed.

At his first trial, defendant was convicted by a jury of two counts of a 17-count indictment. Upon defendant’s posttrial motion, alleging prosecutorial misconduct, the County Court dismissed the two counts of which he had been convicted.
