This is an appeal from a decree of the circuit court of Franklin county dismissing a suit brought by John Darwin Ellison, a minor, by his mother and next friend, against Terzie K. Ward, trustee of the estate of Bobert B. Ward, deceased, et al. The reason for the dismissal was the failure of plaintiff to file a cost bond within the time limited by rule of the trial court. Complaint is also made that the chancellor erred in denying plaintiff’s motion for leave to file an amended and supplemental bill.
