This action was commenced -before tbe city justice of Owatonna, from whose judgment an *313appeal was taken to the district court on questions of law alone. From the judgment of the district court affirming the judgment of the justice an appeal is taken to this court. The justice’s summons was directed to the sheriff or any constable of said county, or an adjoining county. The sheriff’s return shows that the summons was served upon the defendant in the county of Freeborn, “ by leaving with him a true copy.” As the statute provides that the summons shall be served by (e…
