*792Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Sullivan County) to review a determination of the Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.

As a result of a gang symbol being discovered on the inside door of petitioner’s medicine cabinet, petitioner was charged with violating the prison disciplinary rules that prohibit the destruction of state property and the display of unauthorized organizational material.
