Plaintiff, August Viermann Bricklaying Company, as employer, brought suit under Section 3309, Revised Statutes 1929 (12 Mo. Stat. Ann., p. 8244), for damages for personal injuries suffered by its employee, August Viermann, Jr., caused, as pleaded, by the negligence of defendant. Plaintiff recovered judgment in the Circuit Court of the City of St. Louis for $30,000 from which judgment defendant duly appealed.
