Affirming.
On the 8th day of July, 1847, a patent was issued to Joseph .Porter for 150 acres of land in what is now Mc-Creary county. This patent was 'based on a survey bear ing date the 25th clay of November, 1846. The first three calls of this survey have never been questioned and the corners designated by these calls may still be identified.
