— Appeal from a judgment of the Supreme Court, New York County (Louis Ñeco, J.), rendered November 4, 1987, convicting defendant upon her plea of guilty of assault in the second degree, and sentencing her to *517an indeterminate term of imprisonment of 3lá to 7 years, dismissed.

The order of the Supreme Court, New York County (Richard Failla, J.), entered May 3, 1989, denying defendant’s motion to vacate the plea is affirmed. Sua sponte, defendant’s May 9, 1989 notice of appeal is deemed a timely application to appeal denial of her motion to set aside the plea, and leave to appeal is granted.…
