HUNT, District Judge.
Yeung Chu Keng, a Chinese person, was arrested on the 25th of April, 1905, at Billings, Mont., charged with being unlawfully within the United States, in violation of the act of Congress approved May 6, 1882, and the acts amendatory thereto and supplementary thereof. The Chinaman was taken before F. P. Sterling, a United States commissioner at Helena, Mont., where he pleaded that he was not unlawfully within the United States, but lawfully therein, and entitled to be and remain in the United States.
