The defendant corporation is a benevolent or charitable institution. It was first incorporated by a special act of the legislature of the state of Kentucky, passed and approved on the first day of April, 1878. The purposes of the corporation are thus stated in the original charter: “To give all possible moral and material aid in its power to its members and those depending on its members, * * * and to promote benevolence and charity by establishing a relief fund from which, on satisfactory evidence of the death of a member of the corporation, who has complied with its lawful requirements, a…
