We deem a detailed statement of this case unnecessary, since that of the Court of Civil Appeals is very comprehensive.

The judgment of the trial court granted a mandatory injunction in favor of Bunch, the plaintiff in error, requiring the destruction of a dam or levee on the land of Thomas, defendant in error. This judgment was reversed by the Court of Civil Appeals, and the case is before us by writ of error. 41 S. W. (2d) 361.- The reversal was, in part at least, because of the insufficiency of the evidence to support the verdict. We must, therefore, permit the reversal to stand, as the…
