In an action to recover damages for, inter alia, wrongful death, the defendant Village of Hempstead appeals, as limited by its brief, from so much of an order of the Supreme Court, Nassau County (Murphy, J.), dated July 19, 1989, as denied that branch of its motion which was for summary judgment dismissing the complaint as asserted against it.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, that branch of the motion of the defendant Village of Hempstead which was for summary judgment dismissing the complaint as asserted against it is granted, and the…
