OPINION

BRETT, Presiding Judge:

Joseph McCastle Jackson was convicted in the District Court of Oklahoma County, Case No. CFR-83-3152, of Conspiracy to Commit Murder in the First Degree and Murder in the First Degree in violation of 21 O.S.1981, § 421 and § 701.7, respectively. The appellant waived sentencing by the jury, and the trial court set punishment at five (5) years' for conspiracy, and life imprisonment for the First Degree Murder, the sentences to run concurrently. On appeal, we AFFIRM.
