LIGHTFOOT, Chief Justice.

The appellee has filed no brief in this court, and we adopt the statement of the case by appellant as correct: August 23, 1893, appellee O. F. Walton, administrator of the estate of J. M. Powers, deceased, brought this suit in trespass to try title in the District Court of Kaufman County, Texas.
