This action is based upon the provisions
of our statute, entitled, “ An act to prevent vexatious suits,” and is subject to the same general principles as are actions on the case, for malicious prosecutions, at common law.
The plaintiff alleges, that the defendants, the East Had-dam Bank, a body politic and corporate, without probable cause, and with a malicious intent, unjustly to vex, harass, embarrass, and trouble the plaintiff, commenced, by a writ of attachment, and prosecuted against him, a certain vexatious suit or action for fraudulent representations, to the injury of said bank, and…
