MEMORANDUM

NORTHROP, Senior District Judge.

Presently pending in this action is a motion for summary judgment filed by defendant, A.H. Robins Company (“Robins”). Defendant Hugh J. Davis, M.D., joins in this motion. The motion is based upon the Oregon statute of limitations and upon the doctrine of res judicata.

FACTS

The basic facts as stated in plaintiffs’ complaint are as follows. Defendant Davis invented the Daikon Shield, an intra-uterine contraceptive device, in 1968. The device was originally marketed by the Daikon Corporation. Subsequently, all rights to the device were acquired by…
