Two cases, tried and, here, submitted together. The former, Wittmayer v. Bank Elevator Co. is at law to recover damages for the conversion of grains; verdict for plaintiffs, judgment entered upon it, motion for new trial made and denied and appeal taken from the order and judgment. The latter case, Bank v. Wittmayer, is in equity to enjoin the defendant, his agents and servants, from interfering with the plaintiff's possession of certain lands on which the grains involved in the other action were grown.
