Lavina A. Suiter died testate in 1914, leaving a husband and four children surviving her. Appellant, J. M. Beale, and appellee, Fannie B. Reynolds, are two of the children, and the litigation is for the purpose of a settlement of her estate and for ascertaining the respective interests therein of these two litigants. Lavina A.
