¶ 1. These consolidated cases are before the court1 for determination of the constitutionality of the elimination of the right to trial by jury in juvenile delinquency cases under Wis. Stat. § 938.31(2)(1995-96).2 Three juveniles contend that the elimination of a jury trial as part of a delin*859quency adjudication violates their state and federal constitutional rights.

¶ 2. We conclude that the provisions in the Juvenile Justice Code (JJC), Wis. Stat. ch. 938, that may subject a juvenile who has been adjudicated delinquent to placement in an adult prison are criminal in nature. Accordingly, the…
