The relator claimed the same offices, by virtue of an appointment alleged to have been made in December, 1865, by the seven directors who were elected by the common council of the city of Rochester, in 1865. The only question involved in this case is the constitutional validity of the act of the legislature passed March 24,1865, entitled “An act to amend' chapter three hundred and eighty-nine of the Laws of 1851." (Sess. Laws of 1851, ch. 181, pp. 303, 304.)
