KRUEGER, Judge.

The appellant was tried and convicted of the offense of being an accessory to the murder of her husband, Charles Hunter, and her punishment was assessed at confinement in the State penitentiary for a term of two years.

The record discloses that Scott McGahe was indicted, tried and convicted of the offense of the murder of Charles Hunter and his punishment was assessed at confinement in the State penitentiary for a term of 10 years; that he had prosecuted no appeal from said judgment of conviction and at the time of the trial of this case was serving his term in the penitentiary.…
