This is an action for a separation, brought by the plaintiff wife against the defendant on the grounds of cruelty, abandonment and nonsupport. The defendant, as an affirmative defense, and by way of counterclaim for an annulment of their marriage, attacks the validity of the plaintiff’s divorce from a previous husband, one Seymour Blair. The divorce was granted by the Circuit Court of Montgomery County, State of Alabama, on the 3d day of March, 1955.
