PAULSON, Justice.
The appellant, North Dakota Real Estate Commission [hereinafter Commission], has appealed from the judgment of the Bur-leigh County District Court reversing the Commission’s decision revoking the real estate broker’s license of Earl Allen [hereinafter Allen]. The district court held that the Commission had no authority under § 43-23-08 of the North Dakota Century Code to revoke Allen’s real estate broker’s license based upon his felony conviction in Federal District Court for filing false income tax returns.
