On the Proofs. The Reporters’ statement of the case: The following are the facts of this, case as found by the court: I. James H. Doyle, after serving for more than 25 years as an enlisted man in the Navy, was, on April 15,1898, rated a mate in the Navy. On March 6, 1899, he was appointed a boatswain in the Navy from that date, and served continuously as such until March 6, 1905, when he was promoted to chief boatswain, in accordance with the provisions of the act of Congress approved March 3, 1899, as amended by the act of April 27,1904, quoted in the petition. Peelle, Ch. J.,

delivered the opinion of the court:

The claimant, after six years’ service as boatswain, was commissioned chief boatswain in the Navy April 14, 1905, to take rank March 6, 1905, the date when he was entitled to examination for promotion. He was paid from March 6, but the amount from that date to the date of his commission was subsequently checked against him. For that deduction this suit is brought.

The question therefore is, From which date should his pay begin?

By the act of March 3, 1899 (30 Stat. L., 1007), it is provided:
