McCALEB, Judge.

On August 8, 1935, the plaintiff’s minor son sustained personal injuries when he fell upon the sidewalk adjacent to the property No. 5922 Catina St. in the City of New Orleans. Plaintiff, alleging that the accident was due to the defective condition of the pavement, brought this suit, individually and as legal representative of his child, against the City of New Orleans and George V. Farish, the abutting proprietor, seeking recovery of damages against them in solido.
