This action was brought by defendant in errpr,' (hereafter referred to as plaintiff,) against the plaintiff in error, (hereafter referred to as defendant,) to recover damages for personal injuries.
Defendant is operating a line of railroad running from Chicago, Illinois, to Buffalo, New York, and is a common carrier o.f passengers and freight. Plaintiff, was at the time of his injury a switchman employed by defendant at its yards in Chicago. At about 1:30 o’clock A.
