In a proceeding pursuant to CPLR article 78 to review a determination of the *771Town Board of the Town of New Windsor which sustained four charges against the petitioner and terminated his employment, the town appeals from an order of the Supreme Court, Orange County (Isseks, J.), dated June 30,1981, which, inter alia, annulled the determination and remanded the matter to the town board for further proceedings on the hearing panel’s report.
