This action was commenced in the district court of Madison county by the defendant in error to recover damages-against plaintiff in error which he alleged were caused by the incorrect transmission of a message from Papillion, this state, to Kansas City, Missouri, delivered by him to the company at its place of business in the former place to be-sent to the latter.
