MEMORANDUM AND ORDER
WALINSKI, District Judge.
This cause came to be heard on the plaintiffs motion for preliminary injunction. The plaintiff, Discount Muffler Shop, Inc. (Discount Muffler) filed this action and asserts that the defendants have infringed plaintiff’s common law trademark rights and alleges acts of unfair competition. Defendants, including Meineke Discount Muffler Shops, Inc.
