The questions presented in this case arise upon demurrer to the plaintiff’s complaint. Suit was brought to recover the penalty of a bond executed by the defendants to plaintiff. The complaint, in which the bond is fully set out, is as follows:

“ The plaintiff, the Pueblo & Arkansas Valley Eailroad Company, a corporation created, organized and existing under and by virtue of the laws of the state of Colorado, having its principal office and place of business at the city of Pueblo, Colorado, complains of the defendants, Daniel L.
