OPINION AND ORDER
GARCIA-GREGORY, District Judge.
On November 3, 2003, following the conclusion of a three-day non-jury trial, this Court ordered the parties, Edwina Qui-ñones Sepúlveda (“plaintiff’) and the United States of America (“United States”), to file post-trial Memoranda of Law as well as proposed Findings of Fact and Conclusions of Law. On December 3, 2003, plaintiff complied with the Court’s order (Docket No. 77), while the United States did so on December 15, 2003 (Docket No. 80).
